Opting Out of Private Cannabis Retail

Research paper by Andrew Colautti (December 2018) for upper-year Windsor Law Municipal Law course.

This paper, written as Ontario municipalities were being asked by the province to decide whether to opt in or out of cannabis retail, sought to determine whether Windsor should opt out of private cannabis retail under s. 41(1) of the Cannabis Licence Act. Viewed through the lens of Canada’s unique legislative framework, and in consideration of the economic benefits to cannabis legalization, weighed against the social and health impacts, this paper argued that Windsor should not opt out of private cannabis retail.
